Politically motivated attacks against civilians are typically evaluated by focusing on objective factors, such as the loss of innocent life, the justness of a rebel organization's political vision, and whether the attacks are successful in advancing that vision. Albert Camus' philosophy on rebellion provides an alternative approach that focuses on subject experience of the rebel. The rebel experiences a genuine moral dilemma created by the passionate desire to fight injustice and the feeling of universal solidarity that encompasses even those who (...) the rebel believes it is necessary to kill. From this standpoint, any action the rebel takes is immoral. Camus thus makes authenticity the focus of his analysis. Authentic rebels continue to value solidarity, which creates a limit on how violence can be used in rebellion. Drawing from The Rebel and The Just Assassins, this paper develops several criteria for immoral but authentic acts of political violence, which are then applied to suicide bomb attacks directed against civilians. One of the most common and frustrating experiences for philosophy instructors is teaching students who have not read the assigned text prior to coming to class. This chapter proposes three specific strategies, supported by the literature on student learning, that encourages and enables students to read and understand assigned texts. Each strategy activates students’ prior knowledge, sets a purpose to read and uses novelty to engage students’ attention. Evidence from experience with these strategies is provided to further support their effectiveness. (...) This is the first full English translation of Bernard Bolzano's masterwork, the Theory of Science (1837)--a monumental and revolutionary study in logic, epistemology, heuristics, and scientific methodology. Each volume includes an introduction which illuminates the historical context of Bolzano's work and its continuing relevance.

The thesis of this book is that Kant employs a single conception of reason throughout his analysis of the fundamental principles of natural science, morality and politics, rational religion, and the practice of philosophy itself, and that this conception is that reason is the source of the ultimate goals or ideals for our conduct of both inquiry and action, but never a faculty that yields cognition of objects that exist independently of us, whether sensible or supersensible. In Neiman’s words, (...) “The basis of Kant’s reconception” of reason “is the denial that the rational is, or is centrally concerned with, the cognitive”, and the heart of his thesis of the unity of reason is his view that “the regulative principles of reason... shape our actions in science, morality, religion and philosophy itself”. Neiman’s work is refreshingly ambitious in its attempt to demonstrate that these generalities hold for all four of the areas she lists, but the general claims themselves will not come as a surprise to contemporary students of Kant. So for the work to succeed, it would have to break new ground in either the detailed analysis of the regulative functions of reason or in our understanding of reason’s general function in unifying the several branches of philosophy as Kant understands it. In my view, the book does neither. Neiman offers some interesting insights about Kant’s treatment of science, morality, and religion, but does not offer a rigorous analysis of the structure of Kant’s thought in any of these areas that goes beyond what many others have already provided. More importantly, she misses the opportunity to make a major advance in our understanding of the general structure of Kant’s thought. For what she describes is really similarities in our use of reason in the various areas of our inquiry and conduct; she does not show how Kant uses his conception of reason to unify the apparently disparate realms of theory and practice, or, in his terms, of nature and freedom. This task dominates the Critique of Judgment, where, far from merely recapitulating his previous accounts of the regulative use of reason in both science and morality, Kant argues as he never did before that we must be able to see the realms of nature and freedom not merely as compatible but as unified, yet also makes explicit the regulative status of reason and of this vision of unity precisely by stating his theory of the unity of reason as the culmination of a theory of reflective judgment. Neiman largely ignores Kant’s own most mature account of the unity of reason. (shrink)

This article begins with a detailed analysis of how the choice situation of a social contract for international business ethics can be constructed and justified. A choice situation is developed by analyzing conceptions of the multinational firm and the domain of international business. The result is a hypothetical negotiation between two fictional characters, J. Duncan Grey and Elizabeth Redd, who respectively represent the interests of businesses and communities seeking to engage in international trade. The negotiators agree on ethical principles governing (...) wages, the environment, and compliance social and cultural norms. These principles are then shown to rest in wide reflective equilibrium with considered moral judgments on international business ethics, which are drawn from international agreements, such as the UN Declaration on Human Rights, and voluntary business initiatives, such as the Global Sullivan Principles and the UN Global Compact. Healthcare is increasingly impacted by chronic short staffing of nurses, which causes and is caused by increased nurse burnout and decreased retention. Nurses’ unions seek to address these problems by proposing safer nurse-to-patient ratios, retention bonuses for working through the COVID-19 pandemic, Personal Protective Equipment (PPE) stockpiles, sabbatical leaves, measures aimed at reducing workplace violence, and maintaining or increasing wages and benefits to keep nurses at the bedside. Chronic short staffing and burnout directly affect the quality and availability of patient (...) care—as the International Council of Nurses has pointed out, there is no healthcare without healthcare workers. This article draws on Neiman’s argument that the US healthcare system is best understood as a system of competing interests aimed at fulfilling the community’s obligation to provide access to quality healthcare. Nurses’ unions use contract negotiations, legislative advocacy, and strikes to pressure other members of the healthcare community to address chronic short staffing, burnout, and retention. Nurses’ unions in the US thus play a unique role in the system of competing interest as an organized group whose primary interest aligns with the community’s obligation to provide access to quality healthcare. This article argues that nurses’ professional duty to care for patients includes a duty to support nurses’ unions as an important way to address the factors outside of nurses’ direct practice that impacts the quality and accessibility of the care that nurses provide to patients. This duty to support unions applies to unionized and non-unionized nurses in the US, and includes duties to participate in union activities, to not cross picket lines, and to avoid work for strikebreaking nurse agencies. Role modelling communicates a standard of behavior to another person. Silent role modelling occurs when this standard can be communicated without articulating reasons for the action; articulate role modelling occurs when it is necessary to articulate reasons in order to effectively role model the standard of behavior, and to avoid misinterpretation. Nurses are role models in virtue of the respect and admiration given to the nursing profession. As such, nurses have role model obligations. This paper examines nurses' role model obligations (...) for healthy behaviors and pandemic precautions. Research often identifies nurses as role models for healthy behavior, despite the fact that nurses are typically no healthier than the general population. This paper argues that nurses do not have a duty to role model healthy behaviors. The ability to adopt healthy behaviors is affected by numerous personal and individual factors. For a nurse to share their struggles to adopt healthy behaviors as articulate ‘imperfect’ role models violates their right to privacy. By contrast, nurses do have a moral duty to role model pandemic precautions during the COVID-19 pandemic, such as correctly wearing appropriate masks, maintaining social distancing, avoiding gatherings of multiple households when pandemic precautions are not being taken, and staying up to date on vaccination. Nurses’ duty to role model pandemic precautions does not involve sharing any personal information. Nurses have a duty to be silent role models when the risk of misinterpretation is low, and a duty to be articulate role models, who explicitly communicate reasons for the role modelled behavior, when necessary to ensure they are not misinterpreted. When articulate role modelling goes beyond the minimal role modelling duty, and imposes a comparative cost to the nurse, articulate role modelling is not obligatory, but supererogatory. (shrink)

The feeling of home can be disrupted by moving to a new dwelling, community or nation, or by experiencing changes to one’s dwelling or community while remaining in place. Immigration can cause both a disruption to the feeling of home for immigrants and for those living in the community immigrants settle in. Traditional communitarianism seeks to protect current members from changes resulting from immigration. (...) Recent labor disputes between registered nurses and hospitals in Minnesota, California, and Pennsylvania raise moral questions about nurses’ professional obligations, nurses’ right to collectively bargain to preserve or improve wages, benefits, and working conditions, and patients’ right to medical care. Deontology and consequentialism focus too narrowly on nurses and patients, and thus ignore the nature of the healthcare community as a system of competing interests. When considered in this context, nurses’ strikes are shown to be consistent with this system of (...) competing interests, and thus are morally permissible. (shrink)

This article examines the reasons why Plato endorses obedience to absolute, unchangeable laws, despite the fact that Plato refers to it as only the second best method of rule. Plato's use of the myth, his definition of statesmanship, and the dramatic elements of the dialogue, including its relationship to the Apology, are used to discern why Plato affirms a method of rule so different from that of the Republic. It is argued that Plato's primary concern in the Statesman is practical. (...) In the United States, information about a person’s criminal history is accessible with a name and date of birth. Ruth Crampton has studied nurses’ care for prisoner-patients in hospital settings and found care to be perfunctory and reactive. This article examines whether it is morally permissible for nurses in hospital settings to access information about prisoner-patients’ criminal histories. Nurses may argue for a right to such information based on the right to personal safety at work or the obligation to provide (...) prisoner-patients with the care that they deserve. These two arguments are considered and rejected. It is further argued that accessing information about a prisoner-patient’s criminal history violates nurses’ duty to care. Care, understood through Sarah Ruddick’s account as work and relationship, requires nurses to be open and unbiased in order to do their part in forming a caring relationship with patients. Knowledge of a prisoner-patient’s criminal history inhibits the formation of this relationship and thus violates nurses’ duty to care. (shrink)

This dissertation begins with an exploration of the method John Rawls uses to justify his choice situation, the original position, and his conception of justice, justice as fairness. The method consists of three criteria that Rawls' theory of justice is able to meet, leading him to declare the original position, and the conception of justice be derives from it, philosophically most favored. Once this method of justification has been explicated, a method of evaluating theories of justice that meet the criteria (...) for justification will be established. The primary purpose of this dissertation is to apply this method of justification to Jean-Jacques Rousseau' s social contract theory and comparatively evaluate it against Rawls' theory of justice. The results of this application show that Rousseau's contracting situation and conception of justice are able to meet the three criteria of Rawls' method. This shows that Rousseau's theory is justified in exactly the same manner as Rawls' theory of justice. The two theories are then evaluated, and it is argued that Rousseau's social contract theory must be declared philosophically most favored. (shrink)

In the Dialogues Concerning Natural Religion, Philo and Cleanthes make use of irregular arguments—arguments whose veracity is founded on the force and vivacity with which they strike the mind. This paper provides an analysis of the irregular arguments by the two characters in the Dialogues and by Hume in the Treatise of Human Nature. Since both characters accept the veracity of irregular arguments, it seems that they are in agreement at the end of the Dialogues. The similarity between their arguments (...) and those Hume presents in the Treatise seem suggests that both characters represent Hume’s actual position. (shrink)

We publish here the letters between Gadamer and Ricoeur, as they are found in the Archives of the two philosophers (Gadamer-Archiv in Marbach and Fonds Ricoeur in Paris). Starting from February 1964 and ending on October 2000, the thirty-five letters reproduced here cannot give a complete picture of their much richer correspondence and relations, because it seems that neither Ricoeur, nor Gadamer kept all the letters they received from one another. But altogether, they document their common concerns, their mutual respect, (...) even their intellectual solidarity and finally the particular context that brought them to write to one another, i.e. Ricoeur’s intention to publish a translation of Gadamer’s book, Truth and Method, in a new series he edited for the Seuil Publisher. This publishing and translation project will mark their entire correspondence. (shrink)

A common view is that ceteris paribus clauses render lawlike statements vacuous, unless such clauses can be explicitly reformulated as antecedents of ?real? laws that face no counterinstances. But such reformulations are rare; and they are not, we argue, to be expected in general. So we defend an alternative sufficient condition for the non-vacuity of ceteris paribus laws: roughly, any counterinstance of the law must be independently explicable, in a sense we make explicit. Ceteris paribus laws will carry a plethora (...) of explanatory commitments; and claims that such commitments are satisfied will be as (dis) confirmable as other empirical claims. (shrink)

Brain Computer Interface (BCI) technology offers potential for human augmentation in areas ranging from communication to home automation, leisure and gaming. This paper addresses ethical challenges associated with the wider scale deployment of BCI as an assistive technology by documenting issues associated with the development of non-invasive BCI technology. Laboratory testing is normally carried out with volunteers but further testing with subjects, who may be in vulnerable groups is often needed to improve system operation. BCI development is technically complex, sometimes (...) requiring lengthy recording sessions to achieve the necessary personalisation of the paradigms, and this can present ethical challenges that vary depending on the subject group. The paper contributes to the on-going ethical discussion surrounding the deployment BCI outside the specialist laboratory and suggests some tentative guidelines for BCI research teams, appropriate to those deploying the technology, derived from experience on a multisite project. Any tension between deployment and technical progress must be managed by a formal process within a multidisciplinary consortium. (shrink)

The U.S. Food and Drug Administration's rationale for supporting the development and approval of BiDil for heart failure specifically in black patients was based on under-powered, post hoc subgroup analyses of two relatively old trials , which were further complicated by substantial covariate imbalances between racial groups. Indeed, the only statistically significant difference observed between black and white patients was found without any adjustment for potential confounders in samples that were unlikely to have been adequately randomized. Meanwhile, because the accepted (...) baseline therapy for heart failure has substantially improved since these trials took place, their results cannot be combined with data from the more recent trial amongst black patients alone. There is therefore little scientific evidence to support the approval of BiDil only for use in black patients, and the FDA's rationale fails to consider the ethical consequences of recognizing racial categories as valid markers of innate biological difference, and permitting the development of group-specific therapies that are subject to commercial incentives rather than scientific evidence or therapeutic imperatives. This paper reviews the limitations in the scientific evidence used to support the approval of BiDil only for use in black patients; calls for further analysis of the V-HeFT I and II data which might clarify whether responses to H-I vary by race; and evaluates the consequences of commercial incentives to develop racialized medicines. We recommend that the FDA revise the procedures they use to examine applications for race-based therapies to ensure that these are based on robust scientific claims and do not undermine the aims of the 1992 Revitalization Act. The molecular mechanism of temperature‐dependent sex determination (TSD) is a long‐standing mystery. How is the thermal signal sensed, captured and transduced to regulate key sex genes? Although there is compelling evidence for pathways via which cells capture the temperature signal, there is no known mechanism by which cells transduce those thermal signals to affect gene expression. Here we propose a novel hypothesis we call 3D‐TSD (the three dimensions of thermolabile sex determination). We postulate that the genome has capacity to remodel (...) in response to temperature by changing 3D chromatin conformation, perhaps via temperature‐sensitive transcriptional condensates. This could rewire enhancer–promoter interactions to alter the expression of key sex‐determining genes. This hypothesis can accommodate monogenic or multigenic thermolabile sex‐determining systems, and could be combined with upstream thermal sensing and transduction to the epigenome to commit gonadal fate. The organizational justice literature and the family business literature have developed independently, which limits our understanding of fairness and justice in the family business workplace. So far, the concepts of justice and fairness have been used interchangeably in the family business literature, as if objective measures that aim to increase justice in the workplace will automatically translate into fairness perceptions among family business employees. By integrating the organizational justice literature and the family business literature, we first differentiate between the two (...) concepts of justice and fairness and argue that a utilitarian conceptualization of justice may come into direct conflict with fairness perceptions in the family business workplace. Second, we shed light on the importance of incorporating socioemotional goals, particularly those that reveal a bright side of socioemotional wealth, into rules and regulations designed to increase justice in the workplace, which, we argue, contributes to increasing fairness perceptions among employees and to building and maintaining an ethical family business workplace. Theoretical and practical contributions are discussed at the end of the paper. (shrink)

We investigate notions of randomness in the space ${{\mathcal C}(2^{\mathbb N})}$ of continuous functions on ${2^{\mathbb N}}$ . A probability measure is given and a version of the Martin-Löf test for randomness is defined. Random ${\Delta^0_2}$ continuous functions exist, but no computable function can be random and no random function can map a computable real to a computable real. The image of a random continuous function is always a perfect set and hence uncountable. For any ${y \in 2^{\mathbb N}}$ , (...) there exists a random continuous function F with y in the image of F.
